Indiana law targets employers hiring undocumented workers

By Joe Ulery • Indiana News Service

Indiana’s new FAIRNESS Act gives the state authority to investigate businesses accused of knowingly hiring undocumented workers.

Supporters said the law targets illegal employment. Opponents, including immigrant advocacy groups and some civil rights organizations, argued tougher enforcement could discourage people from reporting crimes or cooperating with police.

Todd Rokita, Indiana’s Attorney General, said the state needs to act on illegal immigration.

“Illegal immigration is no longer just a federal issue,” Rokita contended. “Indiana can and should provide some enforcement, again, because here in Indiana we put citizens above illegal aliens.”

The law creates penalties for employers that knowingly hire undocumented workers. Businesses using the federal E-Verify system or another approved work authorization verification program may qualify for a legal safe harbor.

Rep. Jake Teshka, R-North Liberty, said the measure is intended to support legal immigration while improving coordination among all levels of government.

“This legislation is really built on a pretty simple principle, and that is that Indiana welcomes legal immigrants, but we are going to also expect that our laws be followed,” Teshka explained. “The bill strengthens cooperation between state and local and federal officials.”

The new law is part of Indiana’s latest package of legislation, which took effect July 1.
